2020 г. в съда: Делата намаляват, пропастта в натовареността остава
Рекордьор по дела за разглеждане е съдът в Нова Загора
През 2020 г. в съдилищата са постъпили значително по-малко дела отколкото в предишни години. Ако година по-рано те са били близо 545 000, миналата са 468 000. Това е намаление с близо 15%. Това показват данните от всички съдилища, които влизат в годишния доклад (пълния му текст виж тук), изготвен от председателя на Върховния касационен съд Лозан Панов.
„Заради по-слабото постъпление на дела през годината (476 044 бр. през 2020 г. при 553 839 бр. за 2019 г.) броят на делата за разглеждане от съдилищата през 2020 г. – 602 255 бр., е по-малък със 72 370 бр. в сравнение с 2019 г., когато тези дела са 674 625“, отчита той.
Намалява и броят на свършените дела, те са 473 900 през 2020 г. (548 385 през 2019 г.).
Въпреки намалението на постъпленията, в края на година са останали над 128 000 висящи дела, което е повече от предишната година. Данните отново показват, че системата не може да работи ефективно заради неравномерното натоварване, обясняват от ВКС.
Общото намалението на натовареността във всички съдилища е 8,63%. В доклада се заявява: „За поредна година обаче е видно, че някои от съдилищата са твърде натоварени, което води до по-бавно правосъдие, докато други са недостатъчно натоварени“.
Така сред апелативните съдилища рекордьор е софийският с 10,70 дела месечно за разглеждане на съдия. За сравнение във Военно-апелативния съд тя е 1,13 дела, а във Апелативния специализиран наказателен съд – 4,19.
На окръжно ниво с висока натовареност се отличават Специализираният наказателен съд (26,05 дела) и Софийският градски съд (23,63 дела). Под 8 дела през 2020 г. за разглеждане месечно на един съдия е натовареността на Окръжен съд – Търговище.
„Състоянието на неравномерност на натоварването на съдиите е още по-видимо при данните за районните съдилища. При средна натовареност от 51,08 дела за разглеждане месечно от един съдия в районните съдилища в областните центрове (56,90 през 2019 г.), през 2020 г. натовареността на Софийския районен съд, която намалява, но слабо, е 66,20 дела (71,65 през 2019 г.). Много висока през 2020 г. е натовареността и в районните съдилища в Перник (61,38 дела месечно на един съдия), Пловдив (59,26 дела), Бургас (53,58 дела) и Кюстендил (52,70 дела)“, се посочва в доклада. Те обаче не са сред рекордьорите.
Данните показват, че това са съдилищата в Нова Загора (75,67) и в Котел (75,57), както и в Сливница (68,15 дела), Лом (65,31 дела) и Чирпан (62,75 дела).
На другия полюс са съдилищата в Ивайловград (9,54 дела) Крумовград (18,08 дела), Кула (18,42 дела) и Тополовград (18,58 дела).
Данните показват, че в цялата страна са дадени 5020 разрешения за използване на специални разузнавателни средства. Изготвените и получени веществени доказателствени средства са 1354. Т.е. подслушването и следеното също са намалели в сравнение с предходните две години, когато броят на разрешенията за СРС са бяха около 5400.
Извън статистиката например за това, че през 2020 г. са постановени 33 решения от ВКС по корупционни дела и 14 решения по дела за организирана престъпност, в отчета на председателя на съда Лозан Панов е отделено внимание и на проблемите в работата на съдилищата, за които се посочва, че са причинени от решения на Висшия съдебен съвет.
„През 2020 г. – прибързано, в условията на пандемия и без достатъчно време за предварително използване само в тестова среда, стартира внедряването на Единната информационна система на съдилищата (ЕИСС), за да бъдат спазени сроковете по проекта за нейното изработване и изплащане на средствата по договора с „Информационно обслужване“ АД. След този (фал)старт от редица съдилища са изпратени сигнали за сериозни проблеми със системата, които могат да блокират тяхната работа. Сред тях е и Върховният касационен съд“, се казва в доклада.
За избрания Модел 4 за реформа на съдебната карта в него пише, че този подход е одобрен без широко обсъждане с магистратите, с другите юридически гилдии, с другите власти и с местните общности, както и с ясното съзнание, че тази реформа няма как да бъде осъществена в рамките на мандата на действащия ВСС. „Недоволството на българските магистрати срещу „авангардния“ подход на ВСС (обявяван многократно от членове на ВСС за подкрепян от съдийската гилдия) в края на март 2021 г. безпрецедентно е декларирано от над 500 магистрати от 71 съдилища чрез внасянето във Висшия съдебен съвет на становище срещу одобрения Модел 4 за реформа на съдебната карта“, посочва Панов.
Той отчита, че през 2020 г. представители на другите власти са продължили да се намесват в независимостта на съдебната система чрез свои публични коментари по отношение на решения на съда. И е даден и пример, че декларациите на ВСС, например тази по повод изявление на Валери Симеонов за състав на ВКС (заради какво дело беше то виж тук) не възпират политиците.
„Очевидно приеманите от Съдийската колегия на ВСС позиции и декларации по никакъв начин не оказват влияние върху представителите на другите власти, защото в момента на писането на настоящия доклад, в рамките на предизборната кампания за Народно събрание, заместник министър-председателят по обществения ред и сигурността и министър на отбраната Красимир Каракачанов си позволи да се намеси в работата едновременно на ВКС и на Конституционния съд“, пише председателят на ВКС в отчета по повод на обръщението на Каракачанов заради искането на върховните съдии до КС за тълкуване на понятието „пол“ (повече виж тук).

От къде и от кой идва инициативата и предложението за промяна? Да не чака Главния прокурор да му каже на Лозанчик как да се справи с проблема?

При наказателните дела, особено в районните съдилища, не е спад, а направо срив. И то не само в малките РС. Гледат се основно дела за неспазване на малоумните „противоепидемични“ мерки. И се допълват със статистиката на ЧНД- МНО, ЗСРС, делата по ЗЗ. Все „сериозни“ неща. Но тук съда не е виновен, като му подават от МВР само глупости.. а наркоманите се начупиха да крадат катализатори и мултимедия от МПС, пред всяко училище се продава трева, бум на домовите кражби, въпреки разходките на каскета по селските кръчми.
