Защита в производството по екстрадиция
Екстрадицията е една от формите за международно сътрудничество, чрез които държавите си помагат в областта на наказателното право с оглед разкриването на престъпления, преследване и наказване на извършителите и изтърпяване от тях на наложените им наказания.
Институтът е с много древен произход. Първият известен договор за екстрадиране между Египет и Хетската държава датира от ХІІІ в. пр. н. е.[1]
Терминът „екстрадиция” навлиза ва българският език от френски, като думата е свързана с латинското „tradenda“ – „предавам” и „ехtra“ – „навън“. В по-широк смисъл означава физическото предаване при определени условия на едно лице от една юрисдикция на друга. Чл. 2 от Закона за екстрадицията и европейската заповед за арест[2] (ЗЕЕЗА) свързва екстрадицията с предаване на лице намиращо се на територията на една държава на друга такава или на международен съд във връзка с образувано против това лице наказателно производство, изтърпяване на вече наложено наказание или взета от компетентните власти на искащата държава на мярка, изискваща задържане.
Екстрадицията се прилага само когато искането изхожда от международен съд[3] или от молеща държава, която не е член на Европейския съюз (ЕС). Адвокатска дейност по защита на исканото лице се осъществява, когато адресат на искането за предаване – „замолена държава” е Република България.
Производството по екстрадиция има своите специфики. Особени изисквания към адвоката поставят нуждата от някои познания, наглед несвързани с юридическият аспект на защитата, често прекомерно формалистичното отношение от страна на съда и най-вече бързината, с която се разглежда искането за екстрадиране. Освен това, най-често първият контакт между адвоката и исканото лице е след като същото е вече задържано, което затруднява набирането на доказателства в негова защита. Изложеното, извън редките случаи, при които исканото лице даде съгласие за незабавна екстрадиция, налага при поемане на делото защитникът да изгради незабавно алгоритъм, по който да охрани правата на исканото лице. Подпомагането на този процес е и поводът за публикуването на настоящата статия.
І. Юридическа рамка
Основният вътрешен нормативен акт, регулиращ екстрадицията, е ЗЕЕЗА. Производството е наказателноправно и се развива по реда на Наказателно-процесуалния кодекс (НПК).
Освен вътрешното законодателство, съществено значение за тези дела имат определени международни актове, сред които можем да отличим Европейската конвенция за екстрадиране (ЕКЕ)[4] на Съвета на Европа. Налични са и множество двустранни договори за екстрадиция с различни държави, по които Република България (РБ) е страна.
Пряко отношение към всяко разрешаване на екстрадиция имат Конституцията на РБ и международните договори в областта на човешките права – Международният пакт за граждански и политически права[5] (МПГПП), Европейската конвенция за защита правата на човека[6] (ЕКПЧ), Хартата на основните свободи на ЕС[7], други източници на правото на ЕС. В определени случаи е възможно изходът на делото да е в зависимост от прилагането на Женевската Конвенция на ООН за статута на бежанците от 1951 г.[8], конвенции във връзка с наказателно преследване за определени видове престъпления и др.
Макар ЗЕЕЗА да е основен закон, неговото прилагане е само субсидиарно при наличие на международен договор, по който РБ е страна, като го допълва по отношение на неуредените въпроси. Основанието за това се корени не само в чл. 5, ал. 4 от Конституцията, но и в нарочен законов текст – чл. 4, ал. 1 от ЗЕЕЗА. А когато е налице противоречие с норма от правото на ЕС, приложението е според общите правила за такива случаи[9], като „европейската” норма винаги има примат над вътрешноправната. Тук е важно да се съобразява, че практиката на Съда на ЕС (СЕС) също е източник на правото на ЕС (ПЕС).
ЗЕЕЗА се прилага в пълнота, когато искането за екстрадиция се основава на „взаимност”. Тук това понятие следва да се разбира като „солидарност”, „реципрочност”, в смисъл, че между молещата и замолената държава съществуват такива отношения и макар и без договор, между тях се предоставя помощ по наказателни дела или пък молещата държава декларира такива намерения, обещава, задължава се да отговори положително на подобно искане от страна България[10]. „Взаимността” винаги се установява само и единствено с акт на министъра на правосъдието (чл., чл. 4, ал. 2, чл. 13, ал. 3 ЗЕЕЗА) и липсата му или отрицателната декларация на министъра предпоставят отхвърляне на молбата за екстрадиция и на евентуално предхождащото я искане за временно задържане[11].
ЗЕЕЗА се прилага и когато е получен бюлетин от Международната организация на криминалната полиция (Интерпол) или сигнал от Шенгенската информационна система (ШИС), макар и във втората хипотеза обикновено да важат правилата относно ЕЗА.
Исканията на международен съд също се регулират от ЗЕЕЗА, но е обичайно създаването на такъв съд да е въз основа на многостранен международен договор. Което означава, че при такава хипотеза е възможно прилагането на ЗЕЕЗА да е субсидиарно, в зависимост от уговорките в акта, конституиращ международния съд.
ІІ. Условия за екстрадиция. Предпоставки за допустимост и основания за отказ
Условията, при които е възможно провеждане на производство по екстрадиция, предпоставките за неговата допустимост и основанията, при които се отказва екстрадиране, са така да се каже изнесени пред скоби в закона.
„Условията”, които предпоставя ЗЕЕЗА в своя чл. 5, са общи, те се прилагат при всяко искане за екстрадиция. Основното сред е това за наличие на „двойна наказуемост”, което означава деянието да е наказуемо по наказателния закон и на молещата държава, и на РБ с наказание лишаване от свобода (л. с.) или мярка, изискваща задържане на лицето за не по-малко от една година, или друго по-тежко наказание. Условието се счита за изпълнено, когато независимо от различията, основните признаци на съставите на престъплението по двата наказателни закона съвпадат от обективна и субективна страна.
Ако вече е наложено наказание на исканото лице, то трябва да е със срок от четири и повече месеца. Следващата хипотеза е да е определена някаква мярка от компетентните власти на молещата държава, изискваща задържане за същия срок.
За разлика от „условията”, предпоставките за допустимост по чл. 6 ЗЕЕЗА са изложени отрицателно (кога не се допуска екстрадиция) и са „лични”, отсъствието им се проверява за конкретното лице.
Първите три сред тях са свързани с гражданството на исканото лице.
Едната отрицателна предпоставка е наличието на българско гражданство, което има значение най-често при екстрадиране в „условията на взаимност”, тъй като при сключен международен договор това обикновено е позволено. Но когато лицето е било български гражданин към момента на извършване на деянието, то следва да отговаря за извършеното престъпление пред българските власти по силата на националния принцип, в съответствие с нормата на чл. 4, ал. 1 от НК. Което, както ще видим по-долу, може да създаде основания за отказване на екстрадицията.
Чужди граждани не могат да бъдат екстрадирани, когато са лица, ползващи се с международна закрила или им е предоставено право на убежище, съответно статут на бежанец по съответния ред от някоя държава[12]. Предвид ангажиментите на България по множество международни договори, членството ни в ЕС и разпоредбата на чл. 5, ал. 4 от Конституцията, изразът в чл. 6, ал. 1, т. 2 от ЗЕЕЗА: „предоставено убежище в РБ” следва се тълкува разширително, в изложения смисъл[13]. Основание за това ни дават също така и Женевската Конвенция за бежанците (в частност чл. 1, чл. 33 и чл. Първи от Протокола от Ню Йорк) и особено чл. 78, §2, a) от Договора за функциониране на Европейския съюз (ДФЕС), който съставлява норма от първичното право на ЕС и като такава има пряко действие и директен ефект, със задължително прилагане дори и при противоречие с национална разпоредба, над която има „примат”[14].
Не могат да се екстрадират и лица, ползващи се с имунитет спрямо българската наказателна юрисдикция – дипломати и др.[15]
Важно е изрично да се подчертае, че гражданството, имунитетът и предоставеното убежище трябва да са вече налични към момента на получаване на искането за екстрадиция (чл. 6, ал. 2 ЗЕЕЗА).
Следващото изискване не е свързано с гражданството. Според него би следвало лицето да е наказателноотговорно по българското законодателство – да не е било малолетно към датата на извършване на деянието (ненавършило 14 години) и да е действало в състояние на вменяемост – осъзнавайки свойството и значението на извършеното[16]. Вменяемостта трябва да е налице и към момента на преценка относно допустимостта на екстрадицията – датата на самото съдебно заседание във фазата „по същество“.
ЗЕЕЗА създава и „основания” за отказване на екстрадиция. Те биха могли да се обособят като два вида – „абсолютни”, при които съдът е длъжен да откаже – чл. 7 ЗЕЕЗА и други, наричани понякога в съдебната практика „относителни” или „факултативни”, когато разрешаването на екстрадицията е предоставено на неговата преценка – чл. 8 ЗЕЕЗА.
Екстрадиция задължително се отказва: 1. за политическо или свързано с него престъпление, с изключение на престъпленията, които по силата на закон или на международен договор, по който Република България е страна, не се смятат за политически; 2. за военно престъпление, което не е престъпление по общото наказателно право; 3. ако лицето, чието предаване се иска, ще бъде съдено от извънреден съд в молещата държава или ако срещу него ще бъде приведена в изпълнение присъда, постановена от такъв съд; 4. ако екстрадицията има за цел преследване или наказване на лицето на основания, като раса, религия, гражданство, етническа принадлежност, пол, гражданско състояние или политически убеждения, или се прецени, че съществува риск положението на лицето да бъде утежнено поради някое от тези основания; 5. ако лицето ще бъде подложено в молещата държава на насилие, изтезание или на жестоко, нечовешко или унизително наказание, или не са гарантирани правата му, свързани с наказателното производство и изпълнението на наказанието съгласно изискванията на международното право; 6. за престъпление, което е амнистирано или за което наказателното преследване или изпълнението на наказанието е погасено по давност според законодателството на българската или на молещата държава; 7. когато в Република България за същото престъпление има влязла в сила присъда срещу лицето, чието екстрадиране се иска; 8. ако за престъплението законът на молещата държава предвижда или е наложено смъртно наказание, освен ако молещата държава даде достатъчно гаранции, че смъртното наказание няма да бъде наложено или ако е наложено – няма да бъде изпълнено или ще бъде заменено с друго.
Съдът може да откаже екстрадиция: 1. за деяние, подсъдно на българския съд; 2. когато в Република България за същото престъпление наказателното производство е прекратено; 3. когато в Република България срещу лицето, чието екстрадиране се иска, има висящо наказателно производство за престъплението, за което се иска екстрадиция; 4. ако присъдата е била постановена задочно и лицето не е знаело за наказателното преследване срещу него, освен ако молещата държава даде достатъчно гаранции, че на лицето се осигурява повторно разглеждане на делото с право на защита; 5. за престъпление, което е извършено извън територията на молещата държава, когато законодателството на Република България не позволява провеждане на наказателно производство за такова престъпление.
Както предпоставките, така и основанията са подробно описани в посочените законови текстове. В преобладаващата си част тяхното наличие е съвсем очевидно и обикновено може да се извлече от приложените към молбата документи (чл. 7, т. 2, 3, 6 и 8, чл. 8, т. 1, 4 и 5 ЗЕЕЗА) и от различни официални документи, както и чрез елементарни справки (чл. 6, ал. 1, т. 1, 2, 3. и т. 4, когато лицето е малолетно, чл. 7, т. 7, чл. 8, т. 2 и 3). Относно останалите – в хода на анализа на производството по екстрадиция ще бъдат разгледани по-често срещаните сред тях, чието доказване изисква повече усилия.
ІІІ. Производство по екстрадиране. Защита в неговите етапи
За образуване на дело за екстрадиция е необходимо подаване на молба от искащата държава или международен съд до нашето Министерство на правосъдието. Към нея трябва да са приложени определени документи, посочени в чл. 9, ал. 3 от ЗЕЕЗА. Молбата трябва да е в писмена форма, на езика на молещата държава, с превод на български, ведно със всички приложения и може да се подаде както „на ръка” директно в Министерството, така и по дипломатически път, чрез Интерпол или по друг, уговорен между страните начин. След нейното получаване министърът, лично или чрез оправомощено от него лице, извършва проверка. Тя обхваща съобразяването от страна на молещата държава на формата, пълнотата и съдържанието на молбата и нейните приложения с българския закон и/или международните договорености в двете държави. При наличие на легални причини, молбата се връща на молещата държава, като се посочват основанията за това.
След проверката, при липса на основания за връщане, молбата се изпраща незабавно на Върховната касационна прокуратура (ВКП), която прави собствена проверка[17]. Родовата компетентност е предоставена на Окръжен съд (ОС) като първа инстанция, а местната се определя от местонахождението на исканото лице към момента на установяването му.
Производството във връзка с екстрадиране на исканото лице преминава през няколко фази, като всяко от тях поставя пред защитата свои специфични изисквания.
1. Временно задържане
Временното задържане не е задължителен елемент на производството по екстрадиция, а само една правна възможност за молещата страна. Неговата цел, от гледна точка на молещата държава, е да осуети отбягването на исканото лице от наказателното преследване или от изтърпяването на наложеното наказание, а за българските власти – обезпечаване на присъствието му по същинското дело за екстрадиция. То може да продължи до 40 дни, освен ако в международен договор е определен друг, по-дълъг срок (например според договора ни със САЩ този срок е 60 дни).
Производството е облекчено в сравнение със същинската екстрадиция. Започва с депозиране на нарочна молба без приложения (но обикновено има такива), отправена до МП или директно до ВКП. Тя може да се изпрати по пощата, по факс, телекс или какъвто и да е „друг начин, позволяващ писменото доказване на получаването и на нейното съдържание” (чл. 13, ал. 4 ЗЕЕЗА). На практика, най-често тези молби се депозират чрез Интерпол, самото съдържание на „червената бюлетина” на тази организация съставлява и молба за задържане. Превод на български не се изисква от самия ЗЕЕЗА, но нашите власти правят такъв служебно с оглед нормата на чл. 21, ал. 1 от НПК, според която българският е официалния език на съда.
Искането има задължително съдържание. Според чл. 13, ал. 2 от ЗЕЕЗА в него „се посочва наличието на акт за задържане, за привличане към наказателна отговорност или присъда и намерението на молещата държава да подаде молба за екстрадиция. Молбата трябва да съдържа и информация за престъплението, за което ще бъде поискана екстрадиция, за времето и мястото на извършването му, както и данни за издирваното лице”.
Когато търсеното лице бъде установено на територията на РБ, ВКП издава Постановление за задържането му за срок от 72 часа и изпраща молбата и придружителните към нея документи на съответната Окръжна прокуратура (ОП). Тя от своя страна прави искане пред ОС за временното задържане, като прилага преписката на ВКП. В ЗЕЕЗА оправомощен за тези действия се явява „окръжният прокурор” Трябва да отбележим, че на практика всички действия всъщност се извършват от прокурор от ОП, определен за „наблюдаващ” процеса, като това е валидно и за производството по същинската екстрадиция.
Принципно, едва от този момент в производството встъпва защитник. Срещите с клиента най-често се провеждат в арестни условия, а свободата на придвижване и нормалните контакти на лицето с негови близки са ограничени. Това изисква особена активност от страна на адвоката при изясняване на относимите факти и събиране на нужните му за защитата доказателства. А това често се оказва изключително трудна задача особено когато лицето е чужд гражданин, който няма постоянно местожителство и роднини в България. Желателно е още от този момент да се започне и събиране на необходимите доказателства по евентуалното дело за екстрадиция. Макар и да не е посочено изрично в ЗЕЕЗА, преди процеса, на лицето, чието задържане се иска, съответно на защитника, следва да бъдат предоставени копия както от искането за задържане, така и от всички приложения, преведени на български.
Делото за временно задържане се образува пред съответния ОС като частно наказателно дело (ЧНД) и се разглежда еднолично от съда по реда на НПК – чл. 64, ал. 3 и 5. В него на първо място се изследва пълнотата на приложените документи и приложимостта на ЗЕЕЗА по чл. 4 – наличието на международен договор с молещата страна (и евентуално уговорка в него за предаване на български гражданин, ако лицето, чието задържане се иска е такъв) или наличието на взаимност. В предмета на проверка са също така условията по чл. 5 от ЗЕЕЗА – наличието на двойна наказуемост и на присъда или друг акт, обосноваващ задържане в съответствие с разпоредбите на този законов текст[18]. Изследва се също така дали са налице признаците на „неотложност”[19] на случая (укриване на лицето, нужда от някакви спешни процесуални действия свързани с него и др.). Отсъствието на което и да е от изложените би предпоставило отхвърляне на прокурорското искане. Принципно тук съдът отбягва да навлиза в обсъждане на предпоставките за допустимост и основанията за отказ, които следва да се преценяват от съда в делото по „същинската” екстрадиция. Въпреки това, считам, че очевидното наличие на някоя отрицателна предпоставка или абсолютно основание за отказ, установяеми от наличните документни, би следвало да се посочат пред съда и да се съобразят от него при произнасянето му. Това е така, защото в такива хипотези екстрадиция не е възможна, което превръща временното задържане в изначално незаконно.
В останалата си част производството не се различава от другите такива по определяне мярка за процесуална принуда (МПП) в досъдебното производство. Пред защитника лежи ангажимента да намери, посочи и представи пред съда основания, опровергаващи, намаляващи опасността лицето да се отклони от делото за екстрадицията му. Това може да са: липса на съдимост, положителни характеристични данни, социални причини, факти, установяващи свързаността му с РБ, ако е чужденец, наличието на адрес, на който да пребивава до процеса, влошено здравословно състояние и др.[20] За установяване на тези обстоятелства са допустими всякакви доказателствени средства[21].
ОС се произнася по мярката с протоколно определение в самото заседание и насрочва въззивното производство пред съответния апелативен съд. Срокът за обжалване е три дни. Делото пред горестоящия съд е „пълен въззив” и е допустимо ангажиране на нови доказателства, за представянето на които не е стигнало време или е имало някакви други обективни пречки.
Когато съдът вземе МПП „временно задържане”, при изменение на обстоятелствата, от ОС може да се поиска нейната промяна в по-лека, стига тя да е достатъчна за осигуряване участието на лицето в производството по екстрадиция. Производството е идентично с това при изменение на мярка за неотклонение (МНО) в досъдебното производство.
С радост можем да отбележим, че научно-техническият прогрес изигра своята положителна роля за облекчаване положението на лицата, чието задържане се иска. Все по-често съдилищата не вземат най-тежката мярка, а „домашен арест”, контролиран чрез електронно средство за наблюдение.
След изтичане на срока на съответната МПП, тя би следвало да се отмени служебно от наблюдаващия прокурор при ОП, когато не е пристигнало своевременно искане за екстрадиция. В закона е посочено това му правомощие само относно мярката „временно задържане”, но тук трябва да се приложи разширително тълкуване – за каквато и да е взета МПП. Обичайно се налага защитникът да отправи искане за отмяна. Необходимо е също така да се поиска от наблюдаващия прокурор „сваляне от издирване”, за да не се затруднява възможността на лицето за свободно придвижване. На защитаваното лице обаче трябва да се разясни опасността при евентуално напускане на територията на РБ, да бъде отново задържано в друга държава въз основа на същото искане.
2. Същинска екстрадиция
Действията на прокуратурата след получаване на молбата за екстрадиция са сходни с тези при временното задържане. ВКП образува преписка, задържа исканото лице за срок до 72 часа и я изпраща на прокурор от ОП по местонахождение на издирвания. Наличието на временно задържане, друга МПП, взета във връзка с предстояща екстрадиция или тяхното изтичане, поведението на лицето при изтърпяване на мярката, са без значение, както за 72-часовото задържане, така и впоследствие, при определяне на МПП от съда. Отликите от действията на прокурора във връзка с временното задържане са, че той снема обяснения на исканото лице след запознаването му, неговото, както и на защитника, с материалите по преписката. Прокурорът запознава лицето и с възможността да изрази съгласие пред съда за незабавното му екстрадиране. Материалите по преписката на ВКП се копират и копията се прилагат към искането за задържане на лицето, което се прави от наблюдаващия прокурор пред съответния ОС в 72-часовия срок. Самата преписка се внася отделно в ОС за разглеждането на молбата за екстрадиция по същество. Така пред съда се образуват две отделни ЧНД.
2.1. Вземане на МПП
Споделеното относно временното задържане по чл. 13 ЗЕЕЗА е почти изцяло валидно и тук. Разглеждането на делото е „незабавно” след внасяне на искането, в едноличен състав.
Нерядко, водени от заглавието на тази част на ЗЕЕЗА „Вземане мярка задържане под стража”, съдиите налагат безалтернативно тази мярка[22]. Всъщност, на изследване освен приложимостта по чл. 4 ЗЕЕЗА, условията по чл. 5, от същия, формата и съдържанието на молбата за екстрадиция по чл. 9, пак от него[23], подлежат и всички факти и обстоятелства, които имат значение за преценката, каква е опасността искането лице да се укрие, да се отклони от производството по екстрадицията му[24]. Но все пак, съдът е длъжен да се съобразява, че единствената цел на това производство е обезпечаване на „наличието” на исканото лице в екстрадиционното производство[25], а „пристигналата и приложена екстрадиционна преписка, предстояща за разглеждане, би следвала да се приеме като още по-сериозно основание в посока, че е налице реална опасност исканото лице да се укрие”[26]. Вследствие на което задържането под стража е обичайната налагана мярка.
Оспорването на взетата мярка е идентично с това по временното задържане.
Обикновено темпоралното действие на тази МПП е съвсем кратко, защото в екстрадиционното производство такава се определя отново от съдията докладчик, още при насрочването му. Това предпоставя нуждата от преценка от страна на адвоката доколко да се влагат усилия, ресурс и време в делото за определянето ѝ.
2. 2. Производство по същество
Делото се насрочва пред съответния ОС от съдията-докладчик в седемдневен срок от депозирането на екстрадиционната преписка. Производството е открито и съдът заседава в състав от трима съдии.
В това производство, поне към момента, българските съдилища по никакъв начин не допускат обсъждане на законността, обосноваността, правилността или наличието на нарушения в наказателното производство, провеждано в молещата държава, въпреки че отсъствието им евентуално би могло да създаде индиции за някакви други цели на екстрадицията, различни от законовите, например за политическо преследване. Затова пилеенето на ресурс в обосноваване на такива възражения от страна на адвоката засега е безпредметно[27].
Наличието на някоя от отрицателните предпоставки по чл. 6 ЗЕЕЗА е основание за прекратяване на производството, което би следвало да се направи още от съдията-докладчик, без да се дава ход на делото. Но на практика това рядко е така. Невинаги времето е било достатъчно за установяване и доказване на всички обстоятелства по този текст. Със сигурност, при наличие на индиции за някакви психиатрични проблеми на исканото лице, което не е било малолетно към момента на извършване на деянието, неговата вменяемост трябва да се установи по съответния ред – с извършване на Съдебно-психиатрична експертиза (СПЕ) по конкретното дело. Нейната задача би следвало да е стандартната – вещото лице (лекар-психиатър, евентуално и клиничен психолог) да установи страда ли исканото лице от душевна болест или разстройство на съзнанието, вследствие на което не осъзнава свойството или значението на извършеното или не може да ръководи постъпките си. Наличието на невменяемост у исканото лице към момента на извършване на деянието или към момента на решаване на делото за екстрадирането му е абсолютна отрицателна предпоставка, водеща до недопустимост на производството и обуславяща неговото незабавно прекратяване.
В същинското производство по екстрадиция задължително се изслушват прокурорът, исканото лице и неговият защитник. В предмета на делото са изясняване на наличието на условията по чл. 5 ЗЕЕЗА, отсъствието на отрицателните предпоставки по чл. 6 ЗЕЕЗА и дали има основания за отказ по чл. 7 и чл. 8 от ЗЕЕЗА.
В тези производства служебното начало е засилено, но въпреки това, защитникът трябва да извърши собствена проверка. Нерядко екстрадицията се отказва по причини, изведени от някои от абсолютните основания по чл. 7 от ЗЕЕЗА. Което предполага по-обстойното им обсъждане:
По т. 1 Тук трябва да се има предвид, че общо взето няма държава, в чийто наказателен закон да е налице част, именувана „политически престъпления”. Липсва и ясна дефиниция за такова. Съответно възможността за установяване и доказване на такова основание е малко вероятна. Въпреки това, когато е общоизвестно, че молещата държава е с авторитарен, тоталитарен, военен или теократичен режим[28] и при наличието на данни за дисидентски прояви на исканото лице или на участието му в антиправителствени такива, или изразяването от негова страна публично на мнение против държавни органи, може да породи съмнение, дали преследването не е всъщност на политическа основа. Поради това, при наличие на доказателства в подобна насока, те трябва да се представят пред ОС. Тези факти, освен това е възможно да създават риска по чл. 7, т. 4 ЗЕЕЗА, положението на лицето да бъде утежнено поради убежденията му.
Кое престъпление е „политическо“ по смисъла на чл. 3 ал. 1 от ЕКЕ е въпрос, който следва да бъде преценяван във всеки конкретен случай, като се изхожда от общоприетата концепция за това кои деяния имат политически характер, от конкретното съдържание и характеристики на деянието на поисканото за предаване лице, както и от целите, които преследва екстрадиционното производство. В тази връзка трябва да се има предвид, че политическият характер на престъплението се преценява от замолената държава. Съдилищата ни приемат, че „политически” биха могли евентуално да бъдат престъпленията, чийто състав съвпада по основните си белези с някой от посочените в Глава първа на нашия НК – Престъпления против републиката[29]. След което обаче съдът проверява дали по някой закон или международен акт конкретното престъпление не се счита за политическо[30].
Т. 2 предполага проучване и проверка дали съставът на деянието е в главата „Военни престъпления”, както според наказателния закон на молещата държава, така и по нашия НК.
По т. 3, съобразявайки обикновено процесуалния закон на молещата държава, е нужна преценка дали съдът в молещата държава, който ще решава делото на исканото лице или вече го е осъдил, е „извънреден”. В нашето право лисва легална дефиниция, кога един съд е такъв, но в своята практика[31] Конституционният ни съд (КС) е създал определение, от което може да се прецени, налице ли са основните признаци за да се приеме това. Според КС: „Извънреден съд поначало действа извън определения ред и извън общите и специализираните съдилища; правораздава по новосъздадени специално за целта правила, извън общите процесуални правила, установени от съответния процесуален закон за този вид дела; съдиите в него не се избират съобразно установените условия и ред; създава се при извънредни обстоятелства поради възникнала обществена необходимост; действа през определен период от време и преследва предварително набелязана цел.”
Според това определение военният съд невинаги е извънреден съд. Но когато присъдата е от такъв, трябва задължително да се направи проверката за наличие на отрицателното основание по т. 2 на чл. 7 ЗЕЕЗА.
Т. 4 и т. 5 охраняват някои изконни права на исканото лице (на живот, здраве, свобода на изразяване и мнение, самоопределение, справедлив процес и др.), обект на особена защита както от нашата Конституция, така и от ЕКПЧ, ХОС, МПГПП и другите международни актове с такъв предмет. Обикновено с преписката към молбата се прилагат декларации от компетентните органи на молещата държава, с които се гарантира спазването им. Те обаче твърде често са голословни и невинаги следва да се приемат „на доверие”[32]. Особено когато има публикации, посочващи системни нарушения на човешките права в съответната молеща държава. Индиции в тази насока създава и нечленуването на конкретната държава в международните правозащитни организации или изключването ѝ от тях, което от своя страна прегражда възможността за контрол по спазване на правата на исканото лице и изпълнение на поетите с гаранциите ангажименти. За преценката за наличие на опасност от нарушаване на основните човешки права според практиката на ЕСПЧ, съдът „следва да разгледа предвидимите последици от препращането на жалбоподателя към страната по местоназначение, като държи сметка за общата ситуация в нея и за специфичните обстоятелства в случая на лицето”[33]. От своя страна СЕС също е задал ясни стандарти как се извършва преценката за наличие на основания за отказ от екстрадиция. Според него, решаващият съд на замолената държава, членуваща в ЕС, трябва да ползва за обосновката „обективни, точни, надлежно актуализирани ….“[34] данни от авторитетни източници.
Но тук има една важна особеност. Въпреки засиленото служебно начало, задължението „да представи елементите, които биха могли да докажат, че има сериозни основания” да се мисли, че молещата държава би нарушила някое от правата на исканото лице, лежи върху защитника[35], а тежестта евентуално да ги опровергае е за прокуратурата. Задължението да съобрази тези обстоятелства, събере и приобщи относимите доказателства е на съда. Най-често се ползват доклади на междуправителствени правозащитни организации (доклади на комисаря по правата на човека към съвета на Европа, на Комитета на Организацията на Обединените нации против изтезанието, Комитета за предотвратяване на изтезанията и нечовешкото и унизително отношение или наказания на Съвета на Европа, Експертния комитет по действието на европейските конвенции в наказателно правната област и др.) и утвърдени неправителствени такива, например „Хюман Райтс Уоч“, „Уърлд джъстис проджект“ и др . Друг критерий за преценка е наличието на множество негативни отсъждания от международни органи, призвани да бранят човешките права като Комитета за защита правата на човека към ООН в Женева, ЕСПЧ, Междуамериканската комисия за защита правата на човека[36] и др[37]. Допустимо е също съдът по своя инициатива или по искане на защитника да изиска доклади от български правозащитни организации, например БХК[38] за състоянието на защитата на човешките права в молещата държава. Нашите организации разполагат с достатъчен ресурс и контакти, щото да изготвят и представят своевременно такива доклади, които да са обективни и годни за преценяване наличието на опасност от нарушаване правата на исканото лице в молещата държава.
Сред обстоятелствата, предпоставящи основание за отказ, могат да бъдат и мнения и становища на международни организации или техни органи[39].
Според практиката на ЕСПЧ и СЕС[40], лошите условия в пенитенциарните заведения на молещата държава също са основание за отказ от екстрадиция. Те обуславят „нечовешко и унизително отношение” към исканото лице.
Като страна членка на ЕС, ние имаме своите задължения, сред които е да спазваме и прилагаме политиката му в областта на защитата на човешките права. На тази плоскост, недопускането на екстрадиране към държави, системно нарушаващи човешките права, се явява един вид наказание и предупреждения против тях в съответствие с утвърдения глобален режим на ЕС за санкции в областта на правата на човека[41].
Събраните данни трябва да се съобразяват и при наличието на условията по т. 8 на чл. 7 от ЗЕЕЗА.
Т. 6 и т. 7 от чл. 7 ЗЕЕЗА не предпоставят особени усилия на защитата. Преценката по т. 6 за изтекла давност (преследвателна или погасяваща изпълнението на наложеното наказание) се прави чрез съобразяване на относимите норми в наказателните закони на молещата държава и РБ (Глава девета, чл. 79-84 от НК), а амнистирането следва да е направено със закон в молещата държава. Основанието по т. 8 се установява чрез проверка в картона за съдимост на лицето.
Когато исканото лице не дава съгласие за екстрадиране, на изследване подлежат и относителните основания по чл. 8 от ЗЕЕЗА.
По т. 1 – дали деянието е подсъдно на българския съд се определя според териториалния, личния (персонален), реалния и универсалния принципи, регулиращи действието на нашия НК (чл., чл. 3, 4, 5 и 6) по място и с оглед на лицата. Тази точка е израз на суверенитета на държавата ни. Деянието винаги е подсъдно на наш съд, когато към момента на извършването му исканото лице е било български гражданин или е извършено на територията на нашата страна, или с него са засегнати интереси на български гражданин, или на държавата България, или стореното съставлява престъпление против мира и човечеството[42].
Наличието на висящо или вече прекратено наказателно производство против исканото лице в РБ по т. 2 и 3 се установява чрез справка в прокуратурата. Обичайно те се представят от наблюдаващия прокурор. Оправдателната присъда обаче е абсолютно основание по чл. 7, т. 7 от ЗЕЕЗА, а не факултативно по чл. 8 от същия.
Дали исканото лице е съдено задочно – т. 4, е видно от приложенията, представени от молещата държава. Повечето съвременни наказателно-процесуални закони (вкл. нашия НПК – чл. 423) съдържат норми, според които това е основание за възобновяване на делото. Най-често молещата държава обещава такава възможност с нарочна декларация от компетентния орган. Когато искането за предаване е във връзка с някаква МПП, този въпрос обикновено не се изследва, защото лицето се търси и на основание повдигнато обвинение.
Обстоятелствата по т. 5 се съобразяват от диспозитива на повдигнатото обвинение или издадената присъда, от които трябва да са видни датата, мястото, белезите и квалификацията на извършеното деяние. Очевидно, тя не е валидна при престъпления против мира и човечеството.
Обстоятелствата по чл. 8 от ЗЕЕЗА, при които съдът може да откаже екстрадиция, не се обсъждат в случаите когато исканото лице даде съгласие за незабавна екстрадиция[43]. Когато обаче те са налични, е нужна внимателна преценка дали да се премине към това облекчено производство по чл. 19 ЗЕЕЗА. В него съдът проверява само отсъствието на основанията по чл. 7 ЗЕЕЗА (разбира се, при положение че са налице условията по чл. 5 ЗЕЕЗА и липсват отрицателните предпоставки по неговия чл. 6). Наложително е да се съобрази кое е в интерес на исканото лице – в коя държава ще му се предостави по-качества защита и по-справедливо правосъдие, къде потенциалното наказание ще е по-леко по вид, размер и условия на изтърпяване, къде ще бъде обгрижван по-лесно от близките си и ще поддържа по-лесен контакт с тях и пр. Едва след това трябва да се преценява в интерес ли е на исканото лице даване на такова съгласие. Като междувременно не трябва да се забравя, че по силата на чл. 19, ал. 3 ЗЕЕЗА решението на ОС в тази хипотеза е окончателно.
При липса на съгласие, решението на ОС подлежи на обжалване пред съответния апелативен съд в седемдневен срок. Въззивният съд насрочва производството в десетдневен срок. Апелацията е „класическа” и редът за разглеждането ѝ е отново по чл. 17 ЗЕЕЗА. Това все пак е някакво допълнително време, предоставено на защитата. През него може да се прецизират вече посочените пороци в атакуваното решение на ОС, евентуално да се открият нови, да се преосмисли тактиката на защита, да се открият или просто пристигнат нови доказателства. Пред въззивния съд отново са допустими всички доказателствени средства, вкл. гласни. Изключително важно е да се съберат всички доказателства и да се изтъкнат всички обстоятелства, обуславящи недопустимост или неоснователност на екстрадиционното производство. Решението на АС е окончателно.
2. 3. Действия след приключване на производството
В случаите, когато екстрадицията е отказана, ангажиментите на защитника приключват[44] след като отправи искането до съответния наблюдаващ прокурор за уведомяване на органите на МВР за решението на съда и сваляне на лицето от издирване.
Ако въпреки вложените усилия екстрадицията е допусната, възможностите за защита не са окончателно изчерпани. Понякога в тези производства съдилищата нарушават правото на справедлив процес по чл. 6 от ЕКПЧ. Не е изключено, също така, чрез самото екстрадиране в молещата държава да се застрашат същностни човешки права на исканото лице, например защитените от чл. 2 и чл. 3 от Конвенцията. Което създава предпоставки за внасяне на жалба до ЕСПЧ (затова е толкова важно пред националните съдилища се представят всички възражения против екстрадицията, ЕСПЧ не разглежда непредявени пред вътрешните съдилища основания), чието положително решение би създало основания за възобновяване на делото и преразглеждане на случая (доколкото съдилищата се произнасят с решение, чл. 422, ал. 1, т. 4 НПК би следвало да намира приложение).
Фактическото екстрадиране обаче до голяма степен би обезсмислило подобен процес, поради което съществува правната възможност да бъде поискана от ЕСПЧ привременна марка „спиране на екстрадицията” по реда на чл. 39 от Правилника на Съда. За такова искане е създадено подробно ръководство с посочени възможности за контакт, достъпно чрез Интернет[45].
От практическа гледна точка е важно да отбележим няколко неща – документацията трябва да е максимално пълна още при изпращането, като окончателният акт на съда, заверен за вярност и с отметка, че е влязъл в законна сила, може да се изпрати допълнително. За да се получи търсената защитата своевременно, е желателно искането до ЕСПЧ да бъде отправено на обявения факс и да е изготвено на някой от официалните езици на Съда – английски или френски. Ако защитникът не е уверен, че ще се справи с такова производство, е желателно да е постигнал предварителна договореност с колега, вещ в подобни дела или да потърси своевременно помощ от някои правозащитни организации, имащи ресурс и опит пред ЕСПЧ. Такива са например БХК, Български адвокати за правата на човека и др.
В заключение ние, практикуващите юристи знаем, че за съжаление все още нашата страна не може да се приеме като еталон за нивото на опазване на човешките права, но и че тяхната защита у нас се развива и обогатява. Това е валидно и за отношението на българските съдилища в екстрадиционното производство. Все повече нашите съдии преодоляват формализма в тези процеси и отказват да се доверяват необосновано на чужди правоохранителни органи и на даваните от тях гаранции.
Не са малко чуждите страни, в които защитата на правата на хората е на изключително ниско ниво. Често тези държави използват исканията за екстрадиция като нелегитимен инструмент за заглушаване на свободното слово, натиск и справяне с политически опоненти, опозиционери, дисиденти, журналисти и други инакомислещи. Преграда и едно от най-силните оръжия за недопускане това да се случи, се явява именно добрата адвокатска защита по делата за предаване на такива лица по реда на ЗЕЕЗА.
